TITLE: DoD Directive 2310.01E, "The Department of
Defense Detainee Program," September 5, 2006
SUMMARY: This Directive:
- Reissues DoD Directive 2310.01 dated August 18, 1994
to revise policy and responsibilities within the Department of Defense for a
Detainee Program to ensure compliance with the laws of the United States,
the law of war, including the Geneva Conventions of 1949, and all applicable
policies, directives, or other issuances, consistent with DoD Directive
2311.01E, May 9, 2006; Sections 2340 and 2340A of title 18, United States
Code; The Detainee Treatment Act of 2005; Geneva Convention Relative to the
Treatment of Prisoners of War; Geneva Convention Relative to the Protection
of Civilian Persons in Time of War; Geneva Convention for the Amelioration
of the Condition of the Wounded and Sick in Armed Forces in the Field;
Geneva Convention for the Amelioration of the Condition of Wounded, Sick,
and Shipwrecked Members of Armed Forces at Sea; and DoD Directive 3115.09,
November 3, 2005.
- Re-designates, according to DoD Directive 5101.11,
September 3, 2002, the Secretary of the Army as the DoD Executive Agent for
the Administration of Department of Defense Detainee Operations Policy.
- Supersedes Secretary of Defense Memorandum,
"Office of Detainee Affairs," July 16, 2004 and establishes the
responsibilities of the Under Secretary of Defense for Policy as the lead
proponent in developing, coordinating, and implementing policies and
guidance pertaining to detainee operations.
